Copyright & Image Usage Policy

Our approach to creative ownership, client usage and optional promotional permission.

Copyright and client use

For future bookings accepted under the applicable written agreement, the parties may agree that Poelano Media SA retains copyright in original photographs and films it creates, rather than the default commissioned-work position under section 21 of the South African Copyright Act 98 of 1978. Rights of contractors and third parties remain subject to separate arrangements.

After full payment, personal clients receive a perpetual, non-exclusive licence to use delivered work for personal printing, storage and sharing. Commercial usage must be specified separately in writing.

Portfolio and promotional consent

Poelano may request optional, separate consent to use selected photographs and video depicting the booking client on its website, portfolio, social media and advertising. Declining consent does not affect the booking. A client's consent does not grant permission for other identifiable adults, children or third-party materials.

Privacy and withdrawal

Identifiable images and booking information are handled subject to POPIA and applicable privacy rights. Additional permissions may be needed for minors, sensitive occasions and other people. Where processing relies on consent, clients may withdraw it by emailing info@poelanomediasa.co.za. Poelano will cease further consent-based use and take reasonable steps regarding content under its control, subject to law.
